Common Buick Encore Problems

The ECOTEC LFY 2.0T turbocharged engine experiences premature camshaft actuator solenoid failure, resulting in rough idling, reduced power, and diagnostic trouble codes P0010 and P0011 for intake camshaft position.
The 6-speed automatic transmission (6T40) develops a severe shudder during torque converter lockup at 40-60 mph due to degraded transmission fluid and worn converter clutch friction material.
The PCV valve integrated into the valve cover assembly fails, causing excessive crankcase pressure, oil leaks at the rear main seal, and increased oil consumption on the 1.4L turbo engine.
The front wheel bearing and hub assemblies wear out prematurely at 30,000-50,000 miles, producing a loud humming noise that increases with speed and triggering ABS warning light DTC C0035.
The turbocharger oil feed line on the ECOTEC 1.4T develops carbon buildup and restricted flow, leading to turbo bearing failure, blue exhaust smoke, and complete turbocharger replacement at under 70,000 miles.

  • Cash compensation (cash-and-keep settlement)
  • Attorney's fees paid by the manufacturer

Buick Encore Lemon Law FAQ

My Buick Encore has repeated turbocharger failures under warranty. Does California Lemon Law apply?

Yes. Repeated turbocharger failure on your Encore is a substantial impairment of the vehicle's use and value under the Song-Beverly Act. If the dealer has attempted to repair the turbo system two or more times without success, or if the vehicle has been out of service for a cumulative 30 days, the vehicle may be presumed a lemon under California law.

Do I need to go through Buick's arbitration program before filing a Lemon Law lawsuit in California?

No. California does not require you to participate in the manufacturer's arbitration program before filing a lawsuit under the Song-Beverly Act. While Buick may offer its own dispute resolution process, it is entirely voluntary. You have the right to file a civil action directly and recover attorney fees if you prevail.

Can I claim a mileage offset if I return my defective Buick Encore under California Lemon Law?

The manufacturer is allowed to deduct a mileage offset for the miles you drove before the first repair attempt for the defect. The formula is based on the purchase price multiplied by the miles driven before the first complaint, divided by 120,000. Any miles driven after the first repair attempt do not count against you.

What should I document to strengthen my California Lemon Law case for my Buick Encore?

Keep all repair orders, dealer invoices, and written communications with the dealership and Buick customer service. Record the dates your vehicle was dropped off and returned, as cumulative days out of service are critical under the Song-Beverly Act. Photographs, videos of the defect, and a personal log of symptoms can also support your claim.
