Frequently Asked Questions

Everything you need to know about California Lemon Law and working with our attorneys.

What is the California Lemon Law?

The California Lemon Law (Song-Beverly Consumer Warranty Act) protects consumers who purchase or lease defective vehicles. If your vehicle has a substantial defect that cannot be repaired after a reasonable number of attempts, you may be entitled to a refund or replacement. Read our complete guide to California Lemon Law for full details.

Does the Lemon Law apply to used cars?

Used and certified pre-owned vehicles need an individual review. Eligibility depends on the purchase, the warranty issued with the sale, and the repair history. Remaining original warranty coverage or a CPO label alone does not establish eligibility for a lemon law buyback. Send us your purchase and warranty documents for a free review of your options.

How many repair attempts are needed to qualify?

There is no single repair count that decides every case. What is reasonable depends on the defect and the repair history. California's presumption uses specific repair and time-out-of-service factors, with additional conditions including an 18-month/18,000-mile window and any required manufacturer notice. You may still have a claim without meeting that presumption. We can review your repair orders and explain your options.

How much does it cost to hire a Lemon Law attorney?

Nothing out of pocket. California law requires the manufacturer to pay your attorney's fees if you win your case. At Lion Lemon, we work on a contingency basis — you pay nothing unless we win. Get your free case evaluation.

What can I receive if my car is a lemon?

Depending on the facts, a qualifying case may lead to a buyback, a replacement vehicle, or a negotiated cash-and-keep settlement. A buyback can include eligible purchase charges, subject to the applicable mileage offset. When you prevail, California law provides for manufacturer-paid attorney fees. At Lion Lemon, you owe no fees or costs if your claim does not succeed.

How long does a Lemon Law case take?

Timing depends on the repair records, the manufacturer's response, and whether the claim requires litigation. We cannot promise a settlement date. After reviewing your documents, we can explain the next steps and the factors that may affect timing.

Do I need to go to court?

A claim may resolve through negotiation, but litigation can be necessary. Your attorney can explain the process, what participation may be required, and the options available as your case develops.

What types of vehicles does the Lemon Law cover?

The California Lemon Law covers cars, trucks, SUVs, vans, motorcycles, electric vehicles, and other consumer vehicles purchased or leased in California with a manufacturer's warranty. Browse our manufacturer pages to see coverage for specific brands.

Is there a time limit to file a Lemon Law claim?

Yes. Filing deadlines and any notice requirements depend on the applicable law and the facts of your claim. Contact an attorney promptly so your purchase date, warranty and repair records can be reviewed; do not assume a general deadline applies to your case.

What should I do if I think my car is a lemon?

Keep your purchase or lease agreement, warranty documents, repair orders, receipts, and communications with the dealer or manufacturer. Then request a free case review. Follow safety and recall instructions, and ask your attorney how to document any continuing problems.
