The dealer says condensation in the intercooler is a normal characteristic of my TourX. Can I still file a Lemon Law claim?

If the intercooler condensation causes noticeable stumbling and misfires that affect driveability, it is not merely a normal characteristic but a defect that substantially impairs the vehicle's use. Under the Song-Beverly Act, the manufacturer cannot disclaim warranty coverage by labeling a defect as a design characteristic. Document each occurrence and dealer visit.

Does the Song-Beverly Act cover AWD system failures on my Buick TourX?

Yes. The all-wheel-drive system is a core component covered under the powertrain warranty, and its failure substantially impairs the use and safety of the vehicle. Under the Song-Beverly Act, if the AWD system defect cannot be repaired after a reasonable number of attempts, you are entitled to a refund or replacement vehicle.

I purchased my TourX from a private party. Am I still covered under California Lemon Law?

The Song-Beverly Act primarily covers vehicles sold with a new car warranty or dealer-provided express warranty. If you purchased the TourX as a used vehicle from a private party and the original manufacturer warranty is still in effect, you may still have coverage. However, private-party sales without any remaining warranty are generally not covered under the Act.
