The statute of limitations under the Song-Beverly Act is four years from the date you discovered or should have discovered the defect. If the defect arose during the warranty period and you are within that four-year window, you can still file a claim. However, the longer you wait, the harder it may be to gather evidence and documentation.
Can I file a Lemon Law claim if my Nitro was a certified pre-owned vehicle?
If your certified pre-owned Nitro came with a manufacturer-backed warranty, defects that arise during that warranty period are covered under the Song-Beverly Act. Certified pre-owned warranties from the manufacturer are treated similarly to new vehicle warranties for Lemon Law purposes in California.
