Fisker Ocean One Lemon Law FAQ
Does the limited-edition status of my Fisker Ocean One affect my lemon law rights?
No. The Song-Beverly Act does not distinguish between standard and limited-edition vehicles. Your Ocean One is fully protected under California Lemon Law as long as it was purchased or leased new in California with a manufacturer warranty. The limited production run does not diminish your right to a refund or replacement.
Can I receive a replacement Fisker Ocean One if mine is a lemon?
Under Song-Beverly, you are entitled to either a replacement vehicle or a refund at your election. However, because the Ocean One was produced in limited numbers, a direct replacement may not be available. In such cases, a full refund including taxes, fees, and incidental damages is the more practical remedy.
What is the mileage offset in a California lemon law refund for my Ocean One?
The mileage offset is calculated by multiplying the purchase price by the miles driven before the first repair attempt, then dividing by 120,000. For example, if you drove 5,000 miles before the first warranty repair on a vehicle purchased for $70,000, the offset would be approximately $2,917. This amount is deducted from your total refund.
Are aftermarket modifications on my Ocean One going to void my lemon law claim?
Generally, aftermarket modifications do not void your Song-Beverly lemon law claim unless the modification directly caused the defect in question. If the defect is unrelated to any modifications you made, your claim remains valid. The burden of proof is on the manufacturer to show that an aftermarket part or alteration caused the specific problem.
