A vehicle that stalls at intersections puts the driver, passengers, and other motorists at serious risk of collision. Under California law, safety-related defects may require only two repair attempts before the vehicle is presumed to be a lemon.
The Q40 is essentially a rebadged Q50. Does that matter for my California lemon law claim?
No. Your lemon law claim is based on the specific vehicle you purchased and the warranty Infiniti provided for that vehicle. Regardless of platform sharing between the Q40 and Q50, the Song-Beverly Act evaluates whether your particular Q40 has a defect that the manufacturer cannot repair. Platform commonality may actually help demonstrate that the defect is widespread and known to the manufacturer.
I only have two repair attempts documented for my Q40 but the car has been at the dealer for over 30 days. Do I have a claim?
Yes. Under the Song-Beverly Act, a vehicle is presumed to be a lemon if it has been out of service for a cumulative total of more than 30 calendar days due to warranty repairs. You do not need four repair attempts if the 30-day threshold is met. Keep records of every day the vehicle was at the dealership, including dates dropped off and picked up.
Infiniti says the HVAC blower issue in my Q40 does not substantially impair the vehicle. Are they right?
Not necessarily. California courts have held that defects affecting climate control and windshield defrosting can substantially impair a vehicles use and safety. A non-functioning blower motor means you cannot defrost or defog your windshield, which is a safety hazard. The determination of substantial impairment is ultimately a question of fact, and a lemon law attorney can evaluate the strength of your specific case.
