California Lemon Law generally applies to vehicles primarily used in California, regardless of where they were purchased. The key factor is where the vehicle is used and repaired, not where the purchase contract was signed.
Can Infiniti make me pay a mileage offset on my QX80 lemon law claim?
Yes. Under the Song-Beverly Act, the manufacturer is entitled to a reasonable mileage offset calculated based on the miles driven before the first repair attempt for the defect. The formula divides the actual miles at first repair by 120,000 and multiplies by the purchase price. Miles driven after reporting the defect are not counted against you, so report problems early to minimize any offset.
