My Jaguar F-Type R engine developed rod knock. Can I pursue a Lemon Law claim even though the car has high performance?

The Song-Beverly Act does not exclude high-performance vehicles from Lemon Law protection. A connecting rod bearing failure in the AJ133 V8 is a substantial mechanical defect regardless of the vehicle's performance capability, provided the failure occurred under normal driving conditions and not due to abuse. The manufacturer bears the burden of proving that owner misuse caused the defect, and normal spirited driving within the vehicle's design parameters does not constitute abuse.

I took my F-Type R to the track once. Does that void my California Lemon Law rights?

A single track day does not automatically void your warranty or Lemon Law rights under the Song-Beverly Act. The manufacturer must demonstrate a direct causal link between the track use and the specific defect you are claiming. Many F-Type R defects, such as electronic or software-related failures, are clearly unrelated to track driving. However, you should disclose any track use to your attorney so they can properly evaluate your claim.

The active rear spoiler on my F-Type R does not deploy properly. Is this serious enough for a Lemon Law claim?

A malfunctioning active rear spoiler is a safety defect because it provides aerodynamic downforce at high speeds, and its failure can affect vehicle stability. Under the Song-Beverly Act, safety-related defects only require two unsuccessful repair attempts to trigger the lemon presumption. Even if you do not drive at speeds where the spoiler activates frequently, the defect still substantially impairs the value and safety of your F-Type R.

Can Jaguar force me into arbitration instead of a Lemon Law lawsuit for my F-Type R in California?

Under California law, participation in the manufacturer's arbitration program is voluntary for the consumer. Jaguar cannot force you into binding arbitration as a condition of pursuing your Song-Beverly Act rights. You may choose to go through Jaguar's arbitration program first, but if you are dissatisfied with the result, you retain the right to file a lawsuit in court. Many Lemon Law attorneys recommend proceeding directly to litigation for stronger leverage.
