In some cases, fewer repair attempts may be sufficient if the defect is severe or the manufacturer has acknowledged it cannot be fixed.

Under the Song-Beverly Act, the replacement vehicle must be substantially identical to the original, which typically means the same year, make, model, and trim level. If the exact configuration is no longer available, the manufacturer must provide the closest available equivalent. You cannot demand an upgrade to a different model, but if the Sportbrake has been discontinued, the manufacturer must work with you to find an acceptable alternative.

With four unsuccessful repair attempts for the same suspension defect, you have met the presumption threshold under the Song-Beverly Act. Your first step should be sending a written demand letter to Jaguar Land Rover North America via certified mail, requesting a repurchase or replacement. You should include copies of all four repair orders and a description of the ongoing defect.
