If you have complete maintenance records showing timely oil changes and service per the owner's manual schedule, the dealer's claim is unlikely to hold up. Is water leaking through my MKZ's panoramic roof considered a substantial defect for Lemon Law purposes in California?

My MKZ is no longer under the original factory warranty but the transmission problem started during warranty. Can I still file a claim?
Yes, potentially. Under California law, if the defect was first reported to the dealer while the vehicle was still under warranty and repair attempts were made during the warranty period, you may still have a valid Lemon Law claim even if the warranty has since expired. The statute of limitations for Song-Beverly claims is four years from the date you knew or should have known about the defect.
