You should allow the dealer a reasonable opportunity to apply the software update, as this counts as a repair attempt under the Song-Beverly Act. If the motor noise returns after the update, that failed attempt strengthens your lemon law case. Document the date of the update, the software version installed, and how soon the noise recurs. Do not delay filing once it is clear the update did not resolve the defect.
