Under the Song-Beverly Act, four repair attempts for the same non-safety defect generally creates a presumption that the vehicle is a lemon. However, if the roof malfunction creates a safety concern, such as being stuck open during inclement weather, two attempts may be sufficient. Each failed attempt should be documented on a repair order.

Can I get a civil penalty in addition to a refund for my Dawn under the Lemon Law?

Yes. Under the Song-Beverly Act, if the manufacturer willfully failed to comply with its obligations, you may be entitled to a civil penalty of up to two times the actual damages. If Rolls-Royce knew your Dawn had a substantial defect and refused to repurchase it, a court may award this additional penalty.
