Under the Song-Beverly Consumer Warranty Act, if your Atlas has been out of service for a cumulative total of 30 or more calendar days due to warranty repairs, it may qualify as a lemon regardless of whether the repairs addressed the same or different defects. The 30-day period does not need to be consecutive. You should keep copies of every repair order showing the dates your vehicle was at the dealership.
Does the Song-Beverly Act cover VR6 timing chain issues in my Atlas?
Yes, the Song-Beverly Act covers any defect that substantially impairs your Atlas's use, value, or safety during the warranty period. Timing chain and tensioner failures on the VR6 engine are considered powertrain defects that affect both safety and value. If Volkswagen cannot repair the issue within a reasonable number of attempts, you are entitled to a refund or replacement under California law.
Can Volkswagen force me into arbitration instead of a lemon law claim for my Atlas in California?
While Volkswagen offers a voluntary arbitration program, California's Song-Beverly Act does not require you to participate in arbitration before pursuing your legal rights. You may choose to go directly to a lemon law attorney who can negotiate with Volkswagen or file a civil action on your behalf. I bought my Atlas used but it is still under the original factory warranty. Am I protected under California Lemon Law?
