How Vehicle Replacement Works

Under the Song-Beverly Consumer Warranty Act, if your vehicle qualifies as a lemon, you can choose to receive a replacement vehicle of substantially identical type and value instead of a refund.

This means the manufacturer must provide you with a new vehicle that is the same make, model, and trim level as your defective vehicle — or as close as reasonably possible if your exact configuration is no longer in production.

What's Included in a Replacement

Same or comparable model — equivalent make, model, trim level, and options
No mileage offset deduction — unlike buybacks, replacements typically don't involve a mileage charge
Full manufacturer warranty — your replacement vehicle comes with a brand-new warranty
Incidental damages — reimbursement for towing, rentals, and other costs

Replacement vs. Buyback: Which Is Better?

Choosing between a replacement and a buyback (refund) depends on your situation:

Factor Replacement Buyback
Mileage offset No deduction Deduction applies
What you get New vehicle Cash refund
Best when You like the model, just got a bad unit You want your money back
Flexibility Must be same/similar model Use refund for any vehicle

You can also consider a cash-and-keep settlement if you want to keep your current vehicle and receive cash compensation for its diminished value.

Do I Qualify?

The same qualification criteria apply for replacements as for buybacks — your vehicle must have a substantial defect that couldn't be repaired after a reasonable number of attempts. Our attorneys can evaluate your case for free and help you decide which remedy is best for your situation.

We handle replacement claims for vehicles from all major manufacturers across every city in California.
