The CVT in my Forte has been replaced once and is slipping again. How many repair attempts does California require before it is considered a lemon?
California's Song-Beverly Act creates a presumption that a vehicle is a lemon after two or more repair attempts for the same defect that could cause death or serious bodily injury, or four or more attempts for other substantial defects. A transmission that slips during acceleration is arguably a safety defect, so your second failure may already meet the two-attempt threshold. I bought my Forte from a Kia dealer as a certified pre-owned vehicle. Am I covered by California Lemon Law?

The Kia CPO warranty provides additional coverage beyond the original warranty terms, and any defect that arises during that coverage period qualifies for Lemon Law protection. Your rights are the same as if you purchased the vehicle new.
Kia says the steering issue in my Forte cannot be duplicated. Can I still have a valid Lemon Law claim?
A manufacturer's inability to duplicate an intermittent defect does not negate your Lemon Law rights under Song-Beverly. Courts recognize that certain defects, such as intermittent steering assist loss, may not manifest during a short test drive but still substantially impair vehicle safety. Document every occurrence with dates, conditions, and any dashboard warnings, and consider installing a dashcam to capture the defect when it occurs.
