A quick eligibility check
Your Kia may qualify if…
These are common indicators under California's Song-Beverly Act. An attorney reviews the full repair and warranty history before determining whether the firm can take a case.
You bought or leased the vehicle in California.
The problem arose while a manufacturer warranty covered the vehicle.
The dealer has had repeated repair opportunities, or the vehicle has spent significant time in the shop.
The defect continues and substantially affects the vehicle's use, value, or safety.

Why a warranty isn't enough
Your warranty vs. the lemon law
A warranty is a promise to attempt repairs. The lemon law is what protects you when those repairs never stick.
The manufacturer's warranty
- The manufacturer decides which repairs to attempt.
- It only obligates them to keep trying — not to actually fix the problem.
- When the warranty ends, the manufacturer's repair obligation ends.
California's lemon law
- Kicks in when repeated repairs don't fix a substantial defect.
- Can require a refund, a replacement vehicle, or a cash settlement.
- Your legal claim can survive after the warranty ends — if the defect was reported while it was in force.
- When you win, the manufacturer pays your attorney fees — not you.

Kia Lemon Law FAQ
Is the Kia engine recall the same as Hyundai's Theta II issue?
Yes. Kia and Hyundai share the same Theta II 2.0L and 2.4L engines, and the same manufacturing defect affects both brands. Kia Optima, Sorento, and Sportage models are prone to connecting rod bearing failure and engine seizure. The recall and extended warranty do not eliminate your Lemon Law rights. If your Kia experienced engine failure or fire risk during the warranty period, you can pursue a Lemon Law claim in California.
My Kia caught fire. Can I file a Lemon Law claim?
Vehicle fires are among the most serious safety defects and create very strong Lemon Law claims. Kia has recalled millions of vehicles for fire risk related to engine defects, ABS module issues, and electrical shorts. If your Kia caught fire, was recalled for fire risk, or showed signs of fire risk such as burning smell, smoke, or melting components, contact a Lemon Law attorney immediately. You may also have additional claims beyond the Lemon Law.
Does the Kia theft issue affect my Lemon Law claim?
The Kia theft vulnerability, caused by the absence of engine immobilizer technology in certain models, has led to a massive increase in thefts. While the theft issue alone may not qualify as a traditional Lemon Law defect, if Kia's attempted software fix has caused new problems such as engine stalling, battery drain, or warning light activation, those secondary defects can form the basis of a Lemon Law claim.
Can I file a Lemon Law claim for my Kia EV6?
Yes. The Kia EV6 is covered by California Lemon Law. Known issues include 12V battery failures that leave the vehicle unable to start, charging interruptions and incompatibility with certain charging networks, inconsistent regenerative braking, and infotainment system malfunctions. If the dealer has been unable to resolve these issues after multiple attempts, you can pursue a buyback or replacement.
How does the Kia Lemon Law process work in California?
The process begins with documenting your repair attempts. After two or more unsuccessful repairs for the same defect (or 30+ days out of service), contact a Lemon Law attorney for a free evaluation. Your attorney sends a demand to Kia, and most cases settle within 3 to 6 months through negotiation. If Kia does not offer a fair settlement, the case can proceed to arbitration or trial. California law requires Kia to pay your attorney fees if you win, so there is no out-of-pocket cost to you.
