My Ranger's turbocharger failed at 28,000 miles. Ford says it is not covered because I used an aftermarket air filter. Is that legal?

Under the Magnuson-Moss Warranty Act and California's Song-Beverly Act, Ford cannot deny a warranty claim simply because you used an aftermarket air filter unless they can prove the filter directly caused the turbocharger failure. The burden of proof is on the manufacturer, not you. An aftermarket panel air filter that meets OEM specifications should not void your warranty. If Ford denies coverage, request a written explanation and consult a lemon law attorney.

The automatic emergency braking on my Ranger keeps slamming the brakes for no reason. Is this a lemon law safety defect?

Phantom braking from a malfunctioning automatic emergency braking system is a serious safety defect, as unexpected braking can cause rear-end collisions. Under the Song-Beverly Act, only two repair attempts are needed for safety defects that could cause death or serious injury. Each time you bring the Ranger to the dealer for this issue counts as an attempt, even if they simply recalibrate the radar sensor or update software. Document any near-miss incidents caused by the false braking activations.

My Ranger has been making an exhaust ticking noise since I bought it and the dealer cannot fix it. What are my options?

An exhaust leak from broken manifold studs that allows fumes into the cabin is both a safety hazard and a warranty defect. Under California's Song-Beverly Act, if Ford has attempted to repair the ticking noise multiple times without success, you can pursue a lemon law buyback or replacement. The fact that exhaust gases may enter the cabin through the HVAC system elevates this to a safety defect with a lower repair-attempt threshold. Have the dealer specifically document the carbon monoxide risk in the repair orders.

I financed my Ranger and still owe money on it. How does a California lemon law refund work with a loan balance?

Under the Song-Beverly Act, Ford must pay off your remaining loan balance as part of the refund, in addition to refunding any payments you have already made including your down payment. You receive the total amount paid minus a mileage offset for use before the first repair attempt. Ford pays the lender directly to satisfy the loan, and you receive the difference. You are also entitled to reimbursement for registration fees, towing charges, and rental car costs incurred due to the defect.
