Hyundai must repurchase or replace the vehicle if the defect cannot be corrected within a reasonable number of attempts.
Can I pursue a lemon law case for my Elantra if it was purchased used with the original factory warranty still in effect?
Yes, the Song-Beverly Consumer Warranty Act applies to used vehicles that are sold with a remaining manufacturer's warranty or a dealer warranty. If your used Elantra developed a covered defect during the warranty period and the dealer has been unable to fix it, you have the same lemon law protections as the original buyer.
