The Q60 seven-speed transmission shifts harshly. Is that enough for a California lemon law case?
Harsh shifting that substantially impairs the use, value, or safety of your Q60 can qualify under the Song-Beverly Act. Courts have found that transmission defects affecting drivability constitute substantial impairment. You should have the issue documented at an authorized Infiniti dealer at least two to four times to establish a pattern of failed repair attempts.
I purchased an extended warranty for my Q60. Does that affect my Song-Beverly Act rights?
An extended warranty or service contract can actually extend your Song-Beverly Act protections. The Act covers defects that arise during any express warranty period, including extended warranties sold by the manufacturer or dealer. If a covered defect in your Q60 cannot be repaired during the extended warranty period, you may still pursue a lemon law claim.
Can I get a civil penalty against Infiniti if they refuse my Q60 lemon law claim in California?
Yes. Under California Civil Code Section 1794, if the manufacturer willfully fails to comply with its obligations under the Song-Beverly Act, you may be awarded a civil penalty of up to two times your actual damages. If Infiniti knew about the defect, had notice of your repair history, and still refused to repurchase or replace your Q60, a court may find this willful and impose the penalty.
