Does the Song-Beverly Act apply if my BRZ was purchased from a private seller?

The Song-Beverly Act applies if there is still an active manufacturer's express warranty on the vehicle at the time the defect arises. Can Subaru argue that my BRZ is a performance car and the defects are expected in California?

No. The Song-Beverly Act does not distinguish between economy cars and performance cars. Subaru provides the same factory warranty on the BRZ as its other models, and all warranted components must function properly regardless of the vehicle's intended use. A defect is a defect under the Act, and Subaru cannot lower the standard of quality based on the vehicle's performance characteristics.
