Does the new 2023-2024 Prius brake rotor warping issue qualify under Lemon Law even though brakes are wear items?
While brake pads are considered wear items, brake rotors warping at 10,000-15,000 miles is a manufacturing or design defect, not normal wear. Under the Song-Beverly Act, premature brake rotor failure on a new vehicle covered by the basic warranty is a warrantable defect.
