Yes. The Song-Beverly Consumer Warranty Act protects any person to whom the warranty obligation extends, including subsequent purchasers who acquire the vehicle while the original manufacturer warranty is still in effect. You have the same lemon law rights as the original buyer for your GV80.

Genesis says my GV80 air suspension issue is normal wear. Can they refuse a lemon law claim on that basis?

If the air suspension failure occurs within the warranty period and substantially impairs the vehicle, Genesis cannot simply classify it as normal wear to avoid Song-Beverly liability. A suspension compressor failing within the first few years of ownership is not normal wear, and you should request an independent inspection to challenge their characterization.

What is the mileage offset deduction if my GV80 is bought back under California Lemon Law?

The mileage offset is calculated by dividing the miles driven before the first repair attempt by 120,000, then multiplying by the total purchase price. For example, if you drove 5,000 miles before reporting the defect on a $65,000 GV80, the offset would be approximately $2,708. Only miles before the first warranty complaint count.

Do I need to go through Genesis arbitration before filing a lemon law lawsuit for my GV80?
