Inconsistent power steering assist is a safety-critical defect because it can cause loss of vehicle control, particularly during emergency maneuvers. Under the Song-Beverly Act, a safety-related defect typically requires only two repair attempts before a lemon law presumption arises. Report each incident to the dealer in writing and request that the EPS diagnostic trouble codes be recorded on the repair order.
My Venue is an inexpensive car. Is it worth filing a lemon law claim under the Song-Beverly Act?
The Song-Beverly Act applies regardless of the vehicle's purchase price, and the attorney fee provision means you can typically pursue a claim at no out-of-pocket cost. If your Venue has a qualifying defect, Hyundai must repurchase or replace it and pay a civil penalty of up to two times the damages if the violation was willful. The value of your claim includes the full purchase price minus a mileage offset, plus incidental damages.
Does a brake performance issue with my Venue qualify for a California lemon law claim if the dealer blames my driving habits?
The dealer's opinion about your driving habits does not override your rights under the Song-Beverly Act if the brakes are failing prematurely due to a design or manufacturing defect. If the rear drum brake shoes are wearing out or glazing far earlier than expected under normal driving conditions, this may constitute a warranty-covered defect. Make sure to request that each brake complaint is documented on a repair order, regardless of the dealer's stated cause.
