The specific warranty that covers the defective component is what matters. If the hybrid system has a separate, longer warranty, defects arising within that warranty period are covered. The Song-Beverly Act applies to any defect occurring within any applicable manufacturer warranty.
Can Lamborghini argue my Revuelto's issues are expected because it uses new technology?
No. New technology does not excuse manufacturing defects. The manufacturer warranted the vehicle and is obligated to repair it. If the new technology causes a substantial impairment that cannot be fixed, the vehicle qualifies as a lemon under the Song-Beverly Act.
I paid a markup above MSRP for my Revuelto. Is the markup included in a Lemon Law buyback?
California courts have generally held that the actual amount paid is the basis for the refund. If you paid a dealer markup, that amount may be included in your recovery. Retain your purchase agreement showing the total price paid as evidence.
